Sam Fisher sues Best Buy

    Tyler (TX) - Texas customer Sam Fisher is suing Best Buy after he claims an employee dropped a 27-inch television set on his head.

    According to a local newspaper, Fisher was at a Best Buy in Tyler, TX, eyeing a 27-inch TV that was sitting on top of a high shelf. When he called an employee over, the employee allegedly brought over a ladder, climbed up and lost hold of the TV at the top of the shelf. It then fell down, hitting Fisher on the head.

    Fisher is now suing the store, claiming it is guilty of gross negligence. The lawsuit alleges that Best Buy did not have proper training or necessary safety warnings. Moreover, the suit says the retail outlet has no actual policy concerning the procedure of getting an item off a high shelf.

    Fisher is suing Best Buy, not the individual employee, because he says the employee was following the store's policies. By law, under "respondeat superior", the allegations if true would make Best Buy liable for any damages.

    The suit is seeking exemplary damages on the count of Best Buy's "willful, wanton, and reckless disregard for the safety and welfare of its customers." The monetary amount sought by the lawsuit has not been disclosed.

    you mean the policy that says, "Don't stand under a 27 inch TV that's being pulled off a high shelf"? :rolleyes:

    I understand some of you guys dislike frivolous lawsuits, but getting a large tv dropped on your head isn't frivolous. I'm surprised the store doesn't have a policy on this.

    so you don't think the store has any responsibility in this. when I shop at best buy maybe I shouldn't expect to have a television dropped on my head. but that's just how I roll.

    allowing yourself to be underneath a fairly big TV, while someone is taking it off a shelf, should set off the common sense alarm..."hey, that think could get dropped, maybe i shouldnt stand under it."

    but he will probably win. From now on...im standing under anything big and heavy being moved.

    this is sooooooooooooooo stupid. the tv shouldn't be dropped at all.

    i don't really give a damn about BB. they're customer service sux and their practices are downright criminal.

    but some common sense is in order here. you see an employee trying to pull out a 27" TV, standing clear of it would be the smart thing to do. it's not like there was wind shear to all of a sudden blow it over your :eek: head.

    Anywho, Sam will win this lawsuit, unlike many of his arguments...oh wait...;)

    when i worked at circuit city we had a specific policy not help customers load big screen televisions because if they were hurt or it fell the liability was on us. that isn't unusual.

    was it a LCD or CRT?
    an 27in LCD weighs like 10 pounds
    a 27in CRT weighs like 100 pounds

    the ladder is in the isle
    he walked to the opposite side the guy climbs on it. . .to point out
    the one he wants. . . they guy leans out to get it. . it slips forward
    booms. .

    Sh*t Happens. . can't be prepared for everything
