Well that's a sad story. Hate to see anyone go through that kind of pain/anguish. It will be interesting to see if the courts decide the release that protects them from foul-ball related litigation will protect them here too.
Jason Gibson said the lawsuit was filed only after the Astros refused to pay Harughty's medical bills associated with the injury. "Nothing was going to be done," the attorney said. "We were directed to the general counsel, and he basically said 'file your lawsuit.' He asked for it, and he got it. We were hoping to get this resolved, but that didn't happen." That's pretty lame by the Stros.
Unless injury wasn’t caused by the t-shirts and the Astros are confident enough to go to court because of it. Just looking at other side of the coin.
