To the extent that lawsuits create a financial deterrent for sub-optimal business practices I think it's fine.

Now we will need two people on buses at all time? Its stupid. That kid was being a dumbass. No one to blame, but himself.

I always thought city kids these days had so much street sense and savvy, a good head on their shoulders.

    so tragic...

His classmates always said that if he wasn't careful a New Jersey expressway would leave him with a bloody stump where his head used to be.

I dont see a winnable lawsuit here. The hatch on top is an escape hatch in case of an accident. If they locked it to prevent dumbasses from self-terminating themselves, they would be endangering all the other passengers.

Dumb kid ignores rules, dies. Sad story, but should be end of story.

    Yup. So dumb.

Should have at least checked ahead to make sure nothing was coming at the bus.

Was there a sign at the hatch that said not to stick head out for fun that the no doubt buzzed 16 year old could have referenced? If not, that's negligence in our system. SMH

No I'm not. It was anecdotal of our legal system.

as long as youre aware its just an anecdote based on a poor understanding of our legal system, rather than pithy social commentary reflecting any actual substantive knowledge

Guy, I'm not looking for some intellectual internet duke out just because you're an attorney or a law school student. Thanks for your concern. The idea of suing this small business, the driver, the bus mfg or any party here is just as sad as the tragedy of the 16 yr old with what details were made available. That's all.

nobodys sued anyone yet, and suing someone is different than winning a lawsuit. just bc someone on an internet forum laments that people might sue under these circumstances doesnt mean anyone actually will, or that such a claim would have any chance of success. have a little optimism in people and the system. the constant b****ing about imaginary problems is tiresome.

Haha the dude obviously has some sort of legal background or knowledge he is just dying to jab into some conversation. Be on the lookout for him in other threads laying down some solid (and completely unnecessary) habeas corpus.
