If there is Amnesty clause in new CBA, should Rockets use it?

    If the new Collective Bargaining Agreement changes the salary cap and luxury tax numbers significantly it's likely that it will include an amnesty provision allowing teams to reduce salary to better comply. The precedent came after the last CBA was agreed upon. Each team was allowed to cut one player, losing their services and removing their contract from the books for purposes of the total counted towards the luxury tax.

    Things to remember:

    The team was still on the hook for the actual salary payments. The player affected still got the full amount due him under the removed contract, paid out of the pocket of the team's owner. The cost savings to the team came through avoiding the luxury tax. For a team not affected by the tax, cutting a player wouldn't make any sense.
    The player's salary was still counted for salary cap purposes. The amnesty clause did not create space under the cap.
    The team couldn't keep said player, nor could they re-sign them immediately.
    This was a one-time offer. It wasn't savable, repeatable, and there's no guarantee it would ever be offered again. Use it or lose it.


    Rockets don't seem to have a bad contract, but would they consider using it anyway? If signing Yao put them close to the cap, would they consider cutting Thabeet loose?

    Rockets are already under the luxury tax threshold for 2011-12, so the amnesty clause would not apply. Yao Ming's max contract comes off the books, this year.
    The 2010-11 luxury tax threshold is about $70 mil. Even if the league dropped it by $10 mil to $60 mil for 2011-112, the Rockets would have $45-50 mil in salary. They would still be $10-15 mil under the luxury tax threshold for the amnesty clause.

    Nope. Once again the league rules cater to poorly run franchises.

    Brad Miller is an expiring contract for both this year (and next year, if traded next offseason) which is a HUGE asset. People suggesting we would use it on Miller arent thinking.

    Houston would have zero use for an amnesity clause.

    Even if they were under the LT, I'd use it on Brad Miller.

    Wouldn't the luxury tax line be lowered, though?

    We're currently under it right now, but it's still unclear if existing salaries will be decreased, and we don't know what the cap number is right now.

    That's true, but we're gonna be significantly lower than the current LT with Yao of the books and only Scola and Martin with large contracts.

    From Hoopshype, we only have $45,651,205 guaranteed to players. We will resign Hayes and possibly Yao, but I don't see us going over any threshold they come up with.

    Makes no sense to use it. Miller and Thabeet are essentially expiring contracts. You keep them to use in a trade for a big time player if one comes available. Amnesty could help teams like Orlando and Washington ditch Lewis and Arenas. The only way we should use it is if there is a player that becomes available that we want and we need the roster spot to pick him up.
