Honestly, there is no nuance in your opinion. You are a operating in a binary paradigm of open borders vs secure borders. Treating illegally crossings from non violent non drug dealing offenders as a civil offense where the violaters receive a court date to hear their case for legal residency or asylum is not open borders. There will still be border security. There were still be a border will, there still will be enforcement.
