Trump urges House to reauthorize NSA surveillance after ripping it in a tweet

President Trump on Thursday called for the House to renew the National Security Agency’s (NSA) controversial warrantless surveillance program even after expressing frustration over reports that the program had been used to spy on his campaign in 2016. The House is headed for a close vote Thursday over whether to reauthorize the program, which has been criticized for the ease with which prosecutors can obtain warrants from a surveillance court to spy on Americans. The White House has called on the program to be reauthorized, but the president lashed out at the program early Thursday. Trump’s allies have alleged that the FBI used a salacious opposition research memo detailing allegations of Trump-Russia collusion to obtain a Foreign Intelligence Surveillance Act (FISA) warrant to spy on his campaign and transition team.

Trump just torpedoed his own administration’s position on FISA

During a week in which President Trump called himself a “very stable genius,” he has once again proved that the White House he inhabits is not a particularly stable place — thanks to him. In a tweet Thursday morning, Trump called into question his own administration's position on the reauthorization of a program that allows the government to conduct foreign surveillance on U.S. soil, also known as Section 702 of the Foreign Intelligence Surveillance Amendments Act of 2008. Less than 11 hours before the tweet, though, the White House reiterated its position in favor of said reauthorization and against an effort on behalf of libertarian-leaning members of Congress to limit its powers — an amendment known as “USA Rights.”

Here's the statement from press secretary Sarah Huckabee Sanders, sent just after 9 p.m. on Wednesday: The Administration strongly opposes the “USA Rights” amendment to the FISA Amendments Reauthorization Act, which the House will consider tomorrow. This amendment would re-establish the walls between intelligence and law enforcement that our country knocked down following the attacks of 9/11 in order to increase information sharing and improve our national security. The Administration urges the House to reject this amendment and preserve the useful role FISA’s Section 702 authority plays in protecting American lives.

It's pretty clear why Trump tweeted what he did. He's probably not all that tuned in to what's happening in Congress with FISA, and he was apparently watching plenty of TV on Thursday morning. He saw the word “controversial” and “FISA” in a "Fox and Friends" chyron and remembered that it was the program used to conduct surveillance of Trump campaign aides Carter Page and Paul Manafort. Those FISA warrants are at the heart of a deep-state conspiracy theory alleging that the Steele dossier was used as a pretext to spy on his campaign and undermine him. And in Trump's world, things like this are pretty simple: If FISA warrants were used in a way that he perceives as being against him, they are bad.

Following Trump's tweets, Democratic Rep. Adam Schiff, the ranking member of the House Intelligence Committee, recommended that the FISA bill be temporarily withdrawn. "In light of the significant concerns that have been raised by members of our caucus, and in light of the irresponsible and inherently contradictory messages coming out of the White House today, I would recommend that we withdraw consideration of the bill today, to give us more time to address the privacy questions that have been raised, as well as to get a clear statement from the administration about their position on the bill," Schiff said on the House floor.

"I do this reluctantly — Section 702, I think, is among the most important of all of our surveillance programs," Schiff continued. "Nonetheless I think the issues that have been raised will need more time to be resolved." Schiff added that Trump's comments about Obama-era surveillance were "blatantly untrue." "But they nonetheless cast an additional cloud over the debate today," he said. "A better course would be for us to defer consideration."

Sen. Mark Warner, the ranking member on the Senate Intelligence Committee, tweeted that Trump's initial tweet about FISA was "irresponsible, untrue, and frankly it endangers our national security." "FISA is something the President should have known about long before he turned on Fox this morning," Warner said. Former FBI director James Comey weighed in on the FISA debate as well. "Thoughtful leaders on both sides of the aisle know FISA section 702 is a vital and carefully overseen tool to protect this country," he tweeted Thursday. "This isn’t about politics. Congress must reauthorize it."

The big story here is how dangerous it is that FoxNews is now being viewed as a high value asset for shaping Trump's policy making. If the rumors are true that Russia and other countries are working to penetrate Fox to influence our president, that's pretty damn significant.
