So, he interviews Talarico but releases the video only online. Everyone who sees it thinks it aired on the show, Colbert doesn't have to give equal time, and since he has virtually no TV viewers anyway, he still reaches his maximum audience. Meanwhile, Talarico falsely claims that he's being censored and gets free publicity two weeks out from his primary election by claiming that almost a century of federal law is somehow President Trump's fault. An ingenious way of getting around the law indeed...
