Could the Supreme Court rule that the Civil Rights Act is unconstitutional? Yes, they can and they should. That doesn't have anything to do with the equal protection argument with regard to interracial marriage. Were I attacking a law outlawing interracial marriage, I would use both the equal protection argument and the Contracts clause. Really though, the government should get out of the marriage business altogether and treat all citizens the same regardless of marital status. Marriage should be left to the individuals getting married, and whatever non-governmental institutions they want to bring in. So you think black people who think differently than you should have some sort of special word applied to them, because of the color of their skin. Yep, pretty racist. Some arguments don't require much elaboration. The protection of interracial marriage was decided in Loving v. Virginia. The court cites equal protection. The right is not based on the unstable foundation that is substantive due process. There is no reason to think it will go away.
