Specter warns against packing Court

    Now you're sounding like a liberal.

    All sorts of things occur at the state level that many of those outside of the state or in the state don't agree with but the conservative view of federalism is that it should be left up to the states to decide it.

    You know, I see this phrase misused on a constant basis and it irks me. "Packing the court" doesn't mean nominating justices who follow a uniform set of legal beliefs.

    This is what is meant by "packing" the court. (See also: here).

    There has never been and using any shred of logic never should be an expectation that a President will nominate Supreme Court Justices of a widely-varying interpretation of the law. Bush would not be "packing the court" by nominating two, three, or four strict constructionists to the Court. He would be packing the court if he attempted to artificially extend the ideological balance of the Court. And frankly, leaving aside the orgiastic BUSH IS SATAN LOLERZ bull**** some of you believe, there is no evidence to support the theory that Bush would attempt anything approaching that.

    He's going to nominate conservative judges. DUH. He's at least nominally a conservative. There is nothing sinister or threatening about the possibility.

    My point is that the state had decided, then the Dems tried to force a re-consideration of the issue through judicial activism, and the Supreme Court stopped it.

    Is that not a reasonable facsimile of what went on?

    In my neighborhood, "packing the court" means something entirely different. Just be careful out there, don't make eye contact with strangers if you're saying that phrase.

    Its a facsimile colored by political opinion.

    The Democrats or anyone else for that matter were within their rights according to the FL Constitution to ask the FL courts to look into the recounts and further the under the FL Constitution the FL supreme court was fully empowered to rule on the matter.

    The judicial activism was on the federal level when the USSC stepped into rule on a matter that Constitutionally was meant to be a state issue.

Kaine, the party's last vice presidential nominee and a lawmaker with a reputation as an institutionalist, said confirming a nominee of President Donald Trump this year could compel Democrats to consider adding seats to the high court.

    "If they show that they're unwilling to respect precedent, rules and history, then they can't feign surprise when others talk about using a statutory option that we have that's fully constitutional in our availability," he said. "I don't want to do that. But if they act in such a way, they may push it to an inevitability. So they need to be careful about that."

    The precedent that a USSC seat shouldn't be filled in an election year was created by McConnell. If he hadn't done that it's likely Kaine wouldn't have to bring this up.

    McConnell has already said he would fill the seat to show that he doesn't care at all about precedent and will make up the rules as benefits his party. I don't agree with packing the court but I can certainly see why Kaine and Democrats would make the threat to do so if McConnell just continues to just make up rules.

    I hope McConnell tries - structural reform of the courts is long overdue. No filibuster, simple majority, expand the appellate courts, justice term limits, and write some new procedural laws in 28 usc to prevent cheats that Roberts has used to help boost Trump while pretending otherwise, because he is a coward on that.
